The customer must own the footage (video tape) being provided to Spike Media Ltd or have permission from its owner to provide it.
The footage must also be solely for private use and not for any commercial gain and therefore Spike Media Ltd will accept no liability for copyright infringement.
If the material is deemed to be indecent or illegal in nature we reserve the right to refuse to work on it and to contact the relevant authorities.
The customer pays for post and packaging of tapes to the address supplied. Spike Media Ltd pays the return post and packaging costs for the DVDs and tapes.
Refunds or replacement goods will not be given where the DVDs supplied by Spike Media Ltd will not play on a customer's DVD player. Whilst the greatest care is taken with customers' video tapes, there is always a very small element of risk of damage being caused to tapes by equipment during the transfer process. Editing equipment used is maintained in excellent condition and working order. In the unlikely event that damage is caused to a tape during the transfer process this is at the customer's own risk. DVD-R discs are used; customers should therefore check that their DVD player will play these before placing an order or alternatively, state a preferred format.
To the maximum extent permitted by law Spike Media Ltd excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any user's access to or use of the website. All images ore owned by their relevant owners and they have legal ownership.
Orders are accepted on the basis that the liability of Spike Media Ltd for any lost / damaged material shall be limited to its replacement with an equivalent amount of new unused stock. This is due to the problem of being unable to insure objects which have an undefined value. Customers should retain a safety copy or take out a specialised insurance cover if appropriate.
Any damage caused to tapes whilst in the hands of the postal service should be resolved by the customer with the postal service provider.
The customer is responsible for the quality of the movie footage provided for transfer to DVD. The final movie quality on DVD will reflect as near as possible the original throughout.
The customer is responsible for ensuring tapes are suitable for the transfer process.
In the event of cancellation of any order prior to any work being carried out on the project, we will arrange a full refund of any payments (less any costs incurred by us).
In the event of cancellation of an order after commencement of work on the project, a refund will be considered on a one off basis taking into account the cost including labour of the proportion of the work that has been carried out prior to the cancellation request.
Cancellation should be advised as soon as possible to save any further costs being incurred. Refunds can be processed only on receipt of a formal written request.
